Why is it so hard for an Indian to get a US visa?

As you can tell—the answer to this question can vary based on perspective. I’ll offer mine from the legal standpoint. 

First, let me start by saying that Indian visa holders do make up a considerable majority of visas—especially L1 and H1 visas. So its only probable that because that are so many Indian applicants, it may appear that they are also the ones who are denied the most. However, its just simple math that because there are more people from India applying, not only will they receive more visas, but will also be the same group that is denied more often.

Of course, there are factors that are outside of the control of the applicant such as the current political climate that is impacting the ability for anybody from anywhere to obtain a visa. Unfortunately, only time will tell how much of a factor the Trump administration will be in the overall immigration process.

From a legal perspective there are things that you can do to make sure that you put yourself in the best situation possible for approval:

  • Make sure that you qualify for the particular visa process you have selected
  • Be sure that you have filed all necessary supporting documentation
  • Don’t miss important deadlines
  • Show up to your interview
  • Hire an immigration attorney to help

The last point is something people often overlook because they assume that filling out paperwork is a breeze and then the process pretty much completes itself. Wrong.
