Can a US LLC have a partner who is not a US citizen and not residing in the US?

Yes your proposed arrangement is fine. A non-U.S. citizen can own an LLC outright so the 5% owner isn’t even necessary. It may get a little tricky when tax time comes as taxes “pass through” the LLC straight to the owners (called members), but a solid lawyer and / or accountant can help you with all that.

You can set up your LLC (or seek guidance during tax time) with LawTrades. The lawyers on our site will discuss your business plan with you to see if an LLC is even the right entity for you. Thereafter, a lawyer will custom draft the necessary docs to get you started. We also offer free price quotes and flat-fee pricing. Good luck with your venture!
