How long does it take for the USPTO examiner to get back to you after filing an application?

There’s no concrete answer because there are variables outside of your control such as the backlog of the USPTO. If there are a lot of applications in the queue, then it will likely take a while longer. Additionally, if the patent is more complex than others, than it may take a while longer to review.

However, there are things you can do on your end to make sure that you aren’t holding up the process.

  • You should conduct a thorough patent search to ensure that the patent doesn’t already exist (this happens more often than you may think!).
  • You should complete the application thoroughly and correctly.
  • Pay the appropriate fees.
