Can a company sue me for copying their app idea into my app?

Sure. Anybody can sue anybody.

The outcome will come down to a couple of things:

  1. Did the company disclose any information to you that is protected under an NDA?
  2. Does the company have a patent on their app?

If you answered yes to any of the above, then there may be a pretty strong case against you.

It’s no clear how much you know about the status of the patent or even how you came across the information that you may have copied. The best thing for you to do is consult an attorney. If you haven’t infringed on anybody else’s patent, you may very well want to patent the product yourself. As you can see, the lack of a patent opens up a gray area that you really don’t want to be in.

LawTrades can connect you with a seasoned IP attorney that can answer your questions and even help you file you own patent if it’s appropriate. Check out our website and get in touch if you’d like to set up a consultation. Best of luck!
