How can I find out if a logo I’ve created is similar to any existing trademarked logos?

I’ll provide some popular “speedy” and “free” for people looking to do a preliminary search online. I caution you if you’re going to completely rely on these sites though. You should consider hiring an attorney to handle your trademark and other intellectual property (IP) stuff. They will not only assist in navigating the process but also help with things like properly classifying your goods or services, helping you understand the scope of your trademark rights, and suggesting further IP protection. Anyways, here are some links:

  • USPTO’s search engine – the Trademark Electronic Search System (TESS) – “This search engine allows you to search the USPTO’s database of registered trademarks and prior pending applications to find marks that may prevent registration due to a likelihood of confusion refusal.” If you are searching based on a design element then you’ll need the design codes.
  • WIPO’s (the UN’s version of the USPTO) Global Brand Database – “Perform a trademark search by text or image in brand data from multiple national and international sources, including trademarks, appellations of origin and official emblems.”
  • Google Images search – just copy and paste your logo into the search bar
  • ThomsonReuters – not very “free” though
  • Some states have their own search engine. The USPTO has a directoryfor each state’s website.
