Can someone steal my website idea, patent it, and sue me for copyright infringement?

I believe you are talking about copyright rather than patents.

My question to you is, if you are concerned that someone will steal the copyright-worthy aspects of your website (art, music, etc), then why don’t you go through the copyright process yourself?

Now, if you are concerned about a particular service that is brand new and patent-worthy then that is a separate issue as well. You may be better off also going through the patent process if you truly have a unique product or service. Keep in mind, people are able to produce similar products (that’s why there are more than one of most types of businesses!).

Let’s say someone does try to sue you anyway, you may be protected if you can prove that you entered the marketplace first.
