If a company is LLC, but not taken trademark, can it still send cease and desist notice?

There are common law trademark rights that allow a business to claim ownership of a trademark without formally registering with the United States Patent and Trademark Office (USPTO). However, your rights are limited to the geographic regions where your trademark is used. Also, if another company infringes on your name then you will likely end up spending more money litigating in court by failing to register. Thus, formally filing for trademark protection will afford you maximum legal protection from the start.
