What is the difference between a privacy policy and terms and conditions

This is a great question to ask as taking the time to understand the difference between the two can be very valuable later on. A privacy policy is used to inform visitors to your site as to how their information will be collected, stored, and how you are going to share this information. On the other hand, the terms and conditions state what the user must agree to in order to use the website. Knowing the difference between the two will allow you to work hand-in-hand with a lawyer so that they both have the proper terminology included on them.

Your privacy policy should include relevant laws that are applicable to your industry and location of your business. Your ToS should include terms that prevent claims from happening from people that use your website. A common feature of ToS is a disclaimer which states that you cannot be held responsible for any information that may be displayed incorrectly on your site. It should continue on by saying that you cannot be held liable for any information that the user may have depended upon while visiting your website.
