A recent LawTrades user asked: When it comes to starting a business or obtaining a title for your property, Do you need an Attorney?
Having an attorney is essential when starting a new business. As an initial matter, an attorney will be able to help you incorporate your business, advising you on the most beneficial corporate structure for your specific needs. For example, an attorney will be able to advise you on the pros and cons of establishing your business as a limited liability company (LLC) versus establishing it as a limited liability partnership (LLP) or some other corporate entity. An attorney can also draft contracts, agreements and other business forms that you will need to use on a regular basis. If your business is a bakery, for example, an attorney will be able to draft vendor agreements to help you secure your baking supplies. If you are running a tech startup, an attorney can create non-disclosure agreements (NDAs) that you will use whenever you hire new employees, engage consultants, or enter into other types of business relationships. If you have your own dog-walking business, a lawyer can draft a release form for your clients to sign in order to protect you from liability if something goes wrong. As for procuring title to property, there are certainly lawyers who specialize in all aspects of real estate transactions. A real estate attorney would definitely be able to help you procure the title to your property – probably a lot easier than a non-attorney would.
