Is it a good or bad idea to use a utility patent application template that I found online?

Congratulations on coming up with an invention you’d like to patent! The utility patent process can seem daunting as there is a lot of work that goes into running a thorough search and accurately preparing an application that is likely to be approved.

While a patent template that you find online may serve as a good starting point for learning the types of information that you will need to enclose, it is not a good idea to attempt to file a utility patent application with a template from the internet.

Here are a few reasons why:

  1. Patent applications have to comply with unique format rules set out by the USPTO that you template may not comply with.
  2. You will need to draft claims that are very specific to your invention that do not include excess information. A template is not going to be able to help you ensure that your claims are drafted to be successful.
  3. The template you have may not provide you with the full protections that a properly drafted patent can offer.

While taking a stab at a first draft can be helpful to a patent attorney assisting you with the process, it should not take the place of professional counsel.
