What should you keep in mind about using an LLC to limit liability for content you post to your blog?

Here’s a few things that came to mind:

  • Make sure you’re complying with your state formalities for LLCs. Failure to do can “pierce the LLC veil” and expose you to personal liability. For example, if you fail to adhere to your operating agreement or fail to file the annual report.
  • Include a terms of use and/or privacy policy on your blog. Even with an LLC, you may still be exposing yourself to legal risk without such agreements in place. They’re helpful for including disclaimers (which limit your legal liability).
  • For important or popular blog posts, think about applying for a copyright through the U.S. Copyright Office.
