How much differentiation is needed to avoid patent infringement?

Don’t get caught up in the abstract idea of what it means to differentiate.

The most important things you can do to avoid patent infringement is to steer clear of what is specifically outlined in the claims. Your product may have some things that you think sets it apart, but if the patent specifically outlines certain protections and you copy that—then you are infringing on a patent and are exposing yourself to a lawsuit. It’s really that simple.

Of course, claims aren’t the simplest thing to understand or interpret and it would beneficial to look over patent claims with an experienced attorney.

If you would like to be connected with an IP attorney, LawTrades can help. We are more than happy to put you in touch with a highly trained patent attorney that can answer your specific questions and offer insight into the patent process.
