What questions should I ask when interviewing for a Merger and Acquisition lawyer as a company being acquired?

You want to prepare for the worst but hope for the best.

If you approach the situation assuming the worst, then you will think of plenty questions to ask. Specifically, I would ask how they believe the merger would impact your employees, benefits, etc. 

It would also be wise to ask if they would be able to do a “legal checkup” beforehand to ensure that your business is in perfect alignment for a merger. An experienced lawyer could often spot areas of concern and opportunities that you were not aware of. Assistance with that can found here: LawTrades.

They should also be familiar with tax laws and having experience with accounting systems would be a plus so that they can visualize how the two systems will match up.

Federal Authorities such as the U.S. Department of Justice and FTC regularly review M & A transactions to ensure they do not violate anti-monopoly laws. This area of law is extremely complex and your lawyer needs to be well versed in this area.

Mergers & Acquisitions are common so there is no reason as to why the lawyer should not have a wealth of experience relating to this subject. If they are not familiar with the process or the types of businesses that are being merged, you should certainly continue your search.
