If I use a photo from the public domain, do I need to prove that it is public domain and how?

You’re smart for thinking prospectively! If you found a photo in the public domain then you can use it without proving anything to anyone. It’s not until you are accused of infringement by the photo / copyright owner that you would need to prove that the work was in the public domain.
