There are a bunch of things to consider. Here are a few:
- The employment agreement you signed with Google. This will detail any restrictions you may have when it comes to outside work.
- What state you’re in. Some states protect “side jobs” more than other. In California for example, an employee is protected if they perform all work outside of their regular workplace, and it does not relate to their position.
- If your LLC does similar things to your Google position. This is a biggie. Make sure you aren’t using your skills and resources at Google for your LLC
- Make sure to set up, but not work at the LLC. As you said, H1B holders aren’t restricted from forming an LLC, but working at it is totally different.
